Traffic Ticket Problems With GC Services Collection Agency
GC Services collection agency collects on a variety of matters. As a Los Angeles traffic ticket attorney, I’m dealing with GC Services on a daily basis for my clients as it concerns collections activities on their unpaid traffic tickets in Los Angeles County.
GC Services is in contract with the Los Angeles County superior court. Other counties may use other collections vendors like Alliance One. Still other counties conduct their own collections activities, such as Orange County.
But Los Angeles County uses GC Services to collect on unpaid traffic tickets. Since the stated mission of my law firm is to educate the general public and to assist my clients with traffic ticket defense, the purpose of this article is to inform you of the negative consequences associated with paying GC Services.
Should I Pay GC Services Collection Agency on My Traffic Ticket?
There are actually quite a few reasons why you shouldn’t pay GC Services on your traffic ticket. I chose to discuss the top 3 reasons that usually are of highest concern to my clients:
Reason #1: Save Your Criminal Record
When you pay GC Services Collection Agency, you are pleading guilty to Vehicle Code 40508, which is a charge for “failure to appear.”
VC 40508 is a “wobbler” offense, which means it can be filed as a misdemeanor or an infraction. When you pay GC Services, a misdemeanor will appear on your criminal record because it is not being handled in traffic court like it should be.
When handled in traffic court, the VC 40508 charge will be knocked down to an infraction. This is because traffic courts are courts of limited jurisdiction and can only hear infraction matters (traffic tickets are considered “infractions,” meaning they are only punishable by a fine and not punishable by jail).
Reason #2: Save Your DMV Record
When you pay GC Services collection agency on a traffic ticket, you’ll receive a point on your DMV record if that traffic ticket was a moving violation (a “moving violation” is an offense that will result in a point on your DMV record, if you’re convicted).
Getting a point on your DMV record is harmful for at least two reasons:
- It will make your insurance rates go up.
- It puts you one step closer to a negligent operator suspension, which can result in a suspension of your driver’s license for 6 months – one year.
You are only at risk of a negligent operator suspension if you’ve received 4 points in one year, 6 points in two years, or 8 points in three years.
#3 Save Your Bank Account
Paying GC Services Collection agency also means you will pay very high fines, usually for a traffic ticket that could’ve been easily dismissed for a $25 dismissal fee, such as driving without registration under VC 4000.
There are a few reasons why you’re fines will be much higher when you pay collections:
- you’ll have to pay GC Services their collections fee on top of your ticket
- you’ll have to pay the full amount of the failure to appear fine (no ability to offer evidence to reduce this amount)
- you’ll have to pay the full amount of the ticket, as if you were actually guilty (whether or not you were ACTUALLY GUILTY!)
Often handling your ticket in court results in the entire ticket being dismissed (in which case you pay ZERO fines and have ZERO consequences on your criminal record and your DMV record.
(Bonus Reason!) #4: Still Get Your Driver’s License Back
GC Services collection agency will tell you the only way you can get your license back is to pay them. They will even go so far as to lie to you and tell you that you can no longer get a court date.
None of this is true, however. We can get your VC 40509.5 license hold cleared as soon as we see the judge at the first hearing on your case.
Does That Mean I Have to Go to Court?
You can exercise your right to appear in court, even if you don’t have the knowledge on how to do it. As your attorney, I can go to court for your and fight your entire case without the need for you to be present in court with me.
How We Can Help You with GC Services Collection Agency
There are many options available to us when we fight your ticket in court. The best option is a complete dismissal of your entire case, which can happen for several reasons:
- you may have legal defenses available to the charges
- the officer doesn’t show at trial to prosecute
- the officer shows at trial but fails to recollect and can’t proceed
- we may be able to convince the officer to dismiss on other grounds
If we can’t get an outright dismissal on your case, we can often get a large reduction in your fine amount (because of several fees the judge will often waive)
